When it comes to an event of mortgage default, the Courts have, on many occasions, set aside interest rate increases triggered by default, as well as default penalties and late payment charges. It may come as an eye opener to many Lenders that Section 8 of the Interest Act prevents them from charging higher rates on default or automatic renewal of a mortgage. Lenders may also be astonished to learn that provisions made in their mortgage commitments and loan agreements pertaining to mortgage default penalties, fees or fines may be rendered unenforceable due to the effect of Section 8 of the Interest Act. Please come join us as we discover Section 8 of the Interest Act its effects of prohibiting Lenders from charging penalties and increased interest for defaults on a mortgages.

Scott Stephens
Scott is a litigator at Owen Bird who regularly assists institutional and private lenders in banking and security enforcement litigation, including foreclosure and receivership matters. He acts for creditors, trustees and other stakeholders in proceedings under the Bankruptcy and Insolvency Act and primarily acts for secured creditors in proceedings under the Companies’ Creditors Arrangement Act. Scott regularly appears as counsel in the BC Supreme Court and Court of Appeal, as well as in the Supreme Court of Canada. Alan A. Frydenlund
Alan acts for lenders by perfecting their security, safeguarding their security from intervening claims, and by realizing on their security.
As a solicitor Alan acts for clients on various aspects of lending transactions with particular emphasis on representing lenders on secured debt financings for all matter of lending transactions.  As a barrister Alan conducts realization proceedings, including residential and commercial foreclosures, receiverships and acting for clients in proceedings under the Companies’ Creditors Arrangement Act and the Bankruptcy and Insolvency Act.  Alan has conducted realization litigation in Courts in British Columbia, Alberta, Ontario and the Yukon Territory.

Alan has written and presented on legal topics for Continuing Legal Education and the Professional Legal Training Course. Additionally Alan has tendered expert evidence to the British Columbia Supreme Court on financing transactions.

Craig leads the business development team nationally and is responsible for building our strategic customer plans, executing the plans and the achievement of our goals related to Customer Success.

Prior to joining RPS, Craig has had a diverse career in the financial services sector in Canada and the Caribbean.  He has extensive experience in the Appraisal Management sector and have held senior leadership roles with both Nationwide Appraisal Services and FNF Canada.  He has also held leadership roles in mortgage lending, strategy, and credit in both non-prime and prime mortgage business lines during his time at RBC and Home Trust.

Yvonne VonJena, Senior Vice President, Client Solutions.

Yvonne von Jena is responsible for maintaining RPS’ position as the thought leader and innovator in the industry. She works closely with all groups across our organization as well as with our clients and partners, to understand market needs and trends, help develop and bring innovative products to market, and truly add business value to our stakeholders.  She brings over 25 years of experience in developing new business, markets, and products in the financial services and technology sectors.

Previously, Yvonne held new market and business development roles with Asset Inc., First Canadian Title, and Oracle. She has also worked in finance, investment banking, and corporate banking at Deacon Capital, RBC, and a start-up technology venture.

Yvonne has an MBA from the Rotman School of Management in Toronto and a BA in Spanish from the University of Western Ontario. She is also a Six Sigma Green Belt in process excellence.

In the last 10 years Eric has worked with Equifax Canada with a focus on the mortgage, rental and housing industries. As the Equifax ambassador for the mortgage broker market, he has provided extensive support and education to all the varied stakeholders. During his tenure at Equifax, Eric has provided hundreds of presentations and seminars to tens of thousands of brokers, lenders, underwriters, real estate agents, and insurers helping them to understand credit, compliance, financial trends and fraud directly and indirectly related to the mortgage market. Eric’s goal is to educate all members in credit so that they are then able to assist their own end customers in understanding this sometimes misunderstood, but key component during the mortgage process.
